Decades after shaking baby, Dad jailed again...

I agree with what Zaltana said to a certain extent but you can't charge someone with manslaughter or murder if the person didn't die...yet. Whether it be manslaughter or murder 19 years later, the daughter died as a direct result of the injuries she received at the hands of her father. I wish I could give you examples of other cases where a person was attacked and it took them years to die as a result of it and the person responsible was convicted of the crime decades later. I don't know if there is any statute of limitations on manslaughter but there sure as hell isn't any on murder.
oops, i think you took what i said out of context. I don't think the charges are exactly fair. This tiptoes very very close to malicious prosecution i think. A murder charge, as i understand it, requires an "INTENT to kill". And the father, in a highly uncalled for manner, was just trying to get her to stop crying. But he went to far and injured her severely. Both he and his wife were charged for THAT crime and rightfully convicted. Now 19 years later she dies unexpectedly. From reading the article it sounds like she wasn't even expected to make it this far. but the girl JUST HAPPENED to die at 19. If anything that sounds like a manslaughter charge to me. If the girls injuries were known to be eventually fatal, why weren't the past charges more severe? Or did they not know her injuries would prove fatal then and they are just trying to badger a man that is obviously repentant and has made himself a better person? We really don't know, and probably never will.

Another point that pushes the envelope is that the same prosecutor snatched up this case right away, almost like he was waiting for it. Which i know cannot be proven unless he admits it. (don't hold your breath) Making this a murder case is a big stretch IMO.

I guess what don't get is how people are talking like theres a "man slaughter" or "accidental death" aspect to this, I've known from the time when i was a little kid that Shaking a baby = severe brain damage, and death, I would think that is pretty much common sense.
Its not like this is the first case in the news of someone shaking a baby.

That may be my fault ;p

I only meant to bring in manslaughter in regards to Hexx's example of tripping someone. It seemed more like an accident than intentional which is what this father did. Whether or not CAUSING the injury to the baby was intentional (which 9x/10 it's not) is besides the point, the father intentionally shook the baby 'to get it to shut-up' I'm sure, but at 19 he fucking knew what kind of damage that could cause but it's a selfish act out of frustration.

My boyfriend works with a guy who is currently suffering the lose (not death) of his new born because he and his girlfriend left it home with their roommate (19 yr old male) who shook their child causing damage.

They (CAS) took their child from them stating it's their irresponsibility for being young that pretty much made this happen. And they've been fighting ever since to get their baby back. She wasn't even 3 months old when the roomy shook her, and ever since everything has been off. She's not learning at the pace she should be, not responding to things she should. They definitely suspect brain damage but there's no way to really nail a diagnosis until she's older.

Sad fucking story. I feel for the 2 young parents. CAS stated they haven't looked 'emotional' enough when visiting their baby like they should..... so this somehow makes them bad parents.

Everyone has valid points in their disagreements, but the one thing that we all agree on is that he should have got a hell of a lot more time in prison the first time around.

Exactly.

15, 20, 25 years later is 15, 20, 25 years too late.

Exactly, i can agree.

i don't disrespect anyone's opinion and i definitely see where your coming from, I just don't feel that bad for the guy.

Feel worse for his family, and moreso amazed by the courage and beauty of that foster mother.

very true. I don't exactly feel sorry for the guy either. In the end this is all his fault anyway. But two wrongs definitely don't make a right.
