fun fact(?) about screenshots

Yesterday was one of those rare occasions where I ended up with some prolonged human interaction, read: I went out to dinner with friends.

As always, one eventually ends up talking about work, and after some bizarre train of thought, which I do not care to repeat here, we did end up talking about copyright and fair use of screenshots taken. Believe it or not, this was actually work related, as we have an application which puts a copyright notice on every screenshot, their copyright notice, even though none of the content is from them, they just supply the viewer.

Be that as it may, here is what SE has to say about screenshots:

Using the character name display/non-display function in FINAL FANTASY XI, take screen shots without displaying the character name. If you wish to show character names other than your own on the screen shots taken, you must acquire approval from each person prior to posting such screen shots.

If you are not able to acquire approval, use the character name display/non-display function to erase the name or use graphic software to cut out or conceal the corresponding name portion. These modifications will be approved for processing the names only.

I think the Screenshot looks better without any names on it. So this is one Rule I will gladly follow.
 
Well, when it comes to artisitc value it probably does look better without names for the most part, but if it is about the 'Leftnut' and 'Rightnut' Tarus who flank a Galka named 'Dick', I honestly think that character names are essential.

I am not really worried about this stuff. Obviously SE can't prevent people from taking and publishing screens with names turned on, nor do they try to do that per se. They do say that in order for an official Community Site to be one, it would have to stick to those rules. They have the right to do that, just as I have the right to say screw them.

Overall I don't think this is really an issue, as pretty much any FFXI site shows some shots where names are present.

For as much crap that goes on in game due to asshat behaviour, and SE's utter indifference towards it, to this screenshot agreement I say "bah"

Ill obey this when they put an end gilfarming, and we all know, that is not happening anytime soon.

I can just see it, a flock of Japanese lawyers showing up at my door asking me to cease all un-player approved screenshots. I seriously would not put that out of the realm of possibility. I guess its only a matter of time before some ass-tard complains to them that they saw a screenshot of themselves on a forum without giving permission to do so.

Even then, whos at fault? the screenshot taker, or the board owner?

It may seem like Im reading too much into it, but c'mon, it was because of an old lady that foam coffee cups now say "caution!! contents very hot!"

And how about those gel-packs in electronics that say "do-not eat"?

Of course people sue people a lot, and do stupid stuff to land a lawsuit, this world has gone to greed. People in Mass. purposely get into accidents and make it look like the other guy did it to sue them to become rich... :evil:
 
This is pure idiocy. We're not allowed to show another character's name in a screenshot without their permission- why? It's not their real name, so there's no issue with confidentiality. They haven't copyrighted that name. They have exclusive rights to use that name on that game server- that is ALL. Hell, if I wanted to, I could go onto WoW or EQ2 or whatever and make a character named Keits- what would happen? NOTHING, because the name has no legal protection.

(Side Note: Now watch Keits, The Keits, and all other variants be copyrighted, lol.)

The ONLY reason I can understand this, is if the character in question had the name of a real, living person, such as Britneyspears or Alecbaldwin or whatever. But can you really see any of those types suing because some goofball with a geocities site posted up a picture of a Galka with their name floating over it?

No worries, if push comes to shove, QCDN will be there to defend your right to do as you please with the screenshots you take, including hosting those screens in Armenia and thus out of reach of anyone who even remotely looks like a lawyer, if need be. ;)
 
This just seems like standard CYA and pretty unenforceable. Just a "someone got pissed at you for having them in your screenshot? Don't whine to us, we warned you" thing.
 
I can just see some TOTAL loser try to sue someone over such a thing. If it were to happen to me, the "victim" would be murdered by me before I'd hand over a dime.

It's not like we are sneaking up behind someones house and taking pictures of them while they are taking a leak and then putting it on the front page of a peep n tom site. Its a computer generated character not your nekkid body being shown off to the public without your consent, now I wanna go lurk around SE head quaters with a camera and take pictures of them as they hop into there cars to go home and follow them to there homes and take pictures of there guinea pigs, goldfish, and dogs. then when they ask me wtf I am doing I will tell them well you should of gotten rid of the gil sellers.... infact I am really tired so forgive me for my nonsence.
