Judge Booted for Flipping Coin to Decide

By LARRY O'DELL, AP

RICHMOND, Va. —
A judge who ordered a woman to drop her pants and decided a custody dispute by flipping a coin was removed from the bench by the Virginia Supreme Court on Friday. The decision against Juvenile and Domestic Relations Court Judge James Michael Shull of Gate City was unanimous.

"Unless our citizens can trust that judges will fairly resolve the disputes brought before our courts, and treat all litigants with dignity, our courts will lose the public's respect and confidence upon which our legal system depends," Justice Barbara Milano Keenan wrote.

According to the court, Shull admitted tossing a coin to determine which parent would have visitation with a child on Christmas. Shull said he was trying to encourage the parents to decide the issue themselves but later acknowledged that he was wrong.

The pants-dropping incidents, the court said, "were even more egregious."

The court said they occurred when a woman was seeking a protective order against a partner who she said had stabbed her in the leg. Shull knew the woman had a history of mental problems and insisted on seeing the wound, the court said.

The woman dropped her pants once to display the wound, then dropped them a second time after Shull left the bench for a closer look to determine whether the woman had received stitches.

A court bailiff testified before the commission that after the hearing, he asked Shull, "Did you see what that lady had on?" According to the bailiff, Shull replied: "Yeah, a black lacy thing ... it looked good, didn't it?"

Shull denied making the comment. His attorney, Russell V. Palmore, did not immediately return a phone call seeking comment Friday.

The justices could have merely censured Shull, but they noted that he had appeared before the Judicial Inquiry and Review Commission in 2004 for allegedly calling a teenager a "mama's boy" and a "wuss" and advising a woman to marry her abusive boyfriend. That complaint was dismissed with an admonition to Shull to chalk it up as a learning experience.

And that right there is why I would not be a good judge

Good riddance to bad rubbish. At least King Solomon had the sense to threaten to cut a baby in half. Flipping a coin? Lacks imagination.

the only problem that i have with the judge is the comment...

but thats only because im not really a fan of lacy things. Lace is only another place where nothingness can go.

If I were a judge, I'd make my court as much like Phoenix Wright as possible. I'd force the lawyers to shout "OBJECTION!" and point their fingers wildly. I'd also allow witnesses to lie and then later change their testimony several times because they were probably just confused. Yeah, I'd make an awesome judge.

I agree with you 100%. If the prosecution and defense didn't have insane mannerisms and ridiculous style, they would not be allowed in the court room. Also, if evidence is vital, yet presented at not the exact right point, I would make them throw it away and find something new. Hot females would be right no matter what they say until they are proven to have either murdered/stolen/raped/something else ridiculous. Even at that point, I would be reluctant to cast judgement.

I really don't think the flip of the coin was that bad, or asking for the woman to show the wound. But as Hali said, be a bit more creative.

honestly i think the coin flipping thing was pretty funny. Granted had it been something more serious than what it was it would have been totally wrong and would warrent his removal. But honestly, do you really need to get the judicial system involved in something where simply sitting down and talking out the ordeal would suffice? why do people now-a-days seem to depend on everyone but themselves to think for them?

As for the stabbing thing, i believe in our society there's this little thing called "evidence" that's required to charge somebody with a crime...i happen to think that a wound would fall well into the realm of "evidence" to said crime. Granted, asking her to remove her pants in court might have been a bit extreme, but she should have had pictures or something, don't people ever watch judge judy? >.>

on another note....Rappa's Court of Law

Could I call you "Udgey"? :3

The pants thing I can see as being retarded.

The coin thing? Not a bad idea when you think about the alternative of him arbitrarily picking, thus flipping the coin in his head. The parents are both competent parents who both have a claim on children for, what is arguably the biggest holiday of the year (At least for Christian families which this one is). Both sides had a strong case for it and it really is not a question of justice or anything its, there is not guilty verdict, or any sort of penalty or fine, its just pick one or the other. Two equally qualified choices. Why not go with a coin it fits the probability distribution of two equally likely events.
