Microsoft has finally responded to the lawsuit filed by an Illinois couple who lost their baby in a fire allegedly caused by an Xbox. Microsoft, in court papers filed last Friday, says, "Losses and damages, if any, resulted from misuse or abuse of the Xbox console at issue." Microsoft is asking the court to dismiss the lawsuit.

Microsoft did have to replace power cords on the original Xbox back in 2005 due to fire concerns. These cord fire stories even make the rounds at local news stations years after the original incident occurred. Details are still weak as to what's going on here. We know that an original Xbox cord can burn down your house, but we don't really know what the family of the dead infant did to cause the fire like Microsoft claims. Microsoft tried blaming consumers for RROD incidents for the last two years and we know how that ended up.

Microsoft has now officially responded to an Illinois family's lawsuit in which a fire was allegedly caused by a faulty Xbox console in December of 2004. The fire resulted in the death of an infant, Wade Kline. According to the lawsuit, the fire was caused by an overheating power supply, which became so hot as to start the deadly fire. Microsoft, in response, has stated that the fire was wholly the responsibility of the family, and that it was the result of "misuse or abuse" of the console in question. Furthermore, Microsoft claims that the fire was the result of an "obvious" condition of which the family was aware. Considering Microsoft did not recall power cords until February of 2005 (on account of fire concerns) we're not sure to what obvious condition Microsoft is referring. Microsoft is asking that the case be dismissed and that the Kline family pay the company's legal fees.

Xbox doesn't kill babies, an apparent fire started by an xbox killed a baby. And where were the parents? Did they just leave the baby at home and go out thinking itd be okay to leave the xbox on? Or when the fire started did they just run for there lives and then think "OH shit the babies still inside."

Parents sueing a Computer/video game company over something that was their fault? ... That's new =/

I'm surprised I haven't seen the words "Jack Thompson" there yet.

Edit: Added in "?" to first sentence.

It's the parents fault that their Xbox burned their house down?
No, Xbox is responsible for the fire. Its their fault they left the baby unattended.

Sorry, meant to put a ? in it.

But on a serious note, where was the power adapter placed which caused the fire to start? If on a carpet, their fault as it's kinda irresponsible to leave something that can heat up to cause a fire on a flammable surface. If on a non-flammable surface, then It's the company that needs dealing with.

My 360 power adapter is by an open vent with cool air going through it on a non-flammable surface just to be on the safe side.

Edit: And I agree with Uzor and RaiderX about the baby being left unattended. Thats a whole lot more irresponsible than leaving a power adapter on a flammable surface.

Well we don't know the circumstances under which the baby was killed. Don't know how many children were in the house, what time of day the fire was, if any of the parents were injured, ext. We do know the fire occurred during the point of time when MS were denying there was any fault in the power supply and before the eventual recall, that the xbox started a fire, that the baby was killed and that Microsoft is asking the family be forced to pay MS' legal fees.

Kind of lame to lump the blame on the parents. The parents could have had some blame but MS surely has a lot.

You see, this is what our society does, while I agree some fault should be blamed with Microsoft, it should be the parents held more accountable. But no, our society will blame anyone and anything completely so long as it isn't our own faults :| god damn that mentality. A baby shouldn't be unattended.. parents should always be close.. specially close enough to get them to safety if there is a fire.. parents are far more to blame than the company I'd say (though company should still be at blame as well.. it's more of a.. both are to blame thing).

I think we can agree that the parent are irresponsible, and that the Xbox burned their house down. They may or may not have been aware of the recall order, either way the responsibility for the fire most likely falls with Microsoft.

lmao qft XD

An Xbox starts a fire, a baby is killed and you're so quick to blame the parents and dismiss that it was a dangerous, defective product that should have been recalled months before? To top it all off you laugh about it? You're really a piece of shit.

I'm not laughing because the xbox's cable provoked a fire
and much less because a baby died. I should've shortened my quote before, because what made me lol was the supposed events descriptions:

Or when the fire started did they just run for there lives and then think "OH shit the babies still inside."

I think the parents should've read Microsoft's "Xbox with defective cables replacement letter" and changed theirs before this sad incident. If they were the 1st victims and the precautions were taken after this incident, I'm sorry for them because none would've imagined something like that would happen.

I have a testimonial, my original black Xbox is still here and have never caught fire. Thx God.

Recall was in 2005, the fire was in December 2004, back when MS was denying there was a problem. Seems like some corporations have a pattern of denying that their hardware is faulty until it's completely past the point they should have fixed it.

Yea, it seems this is the 1st incident. M$ sucks because of the response they gave them. I'm with you on this and I think this family should get compen$ation. ; ;

ps - But they really are mediocre parents.

If a baby burns to death in a fire and the parents are just fine I am going to assume they are somewhat at fault. Who was playing the Xbox? Why was it on? Who was watching the baby? You don't know the answer to this. You are as quick to put all the blame on Microsoft as they were to put it on the parents. So if you don't think people should make opinions with out all the facts please don't.

I do agree there is nothing to laugh about here.

this is nothing new.
electronics malfuncion all the time resulting in fires. it could be anything.
Remember $ony's exploding laptop batteries?
http://news.softpedia.com/news/Sony-Exploding-Batteries-Chronicles-37848.shtml

Remember how they were charged for KNOWING the batteries would do this and cause fires?
http://www.theinternetpatrol.com/so...ptop-batteries-would-overheat-and-start-fires

hell my house i just moved into has been empty for as long as ive lived in this neighborhood because a cable box converter malfunctioned and burned the house down.
plus side for me was they installed 100% new electrical in this house before i bought it.
happens alot.
They knew the problem was there,
they did a recall after already knowing.
Companies do this alot, its not just MS.
who is at fault? well for the death of the child. the parents. they should have been watching the kid, where were they?
as a parent you better damn believe that i dont care how much fire is raging, im suckin up the pain and running through it to save them if i have to dive out of a window to escape or run back through the fire or not.
why did they leave the system on and unattended?
MS would only be at fault for the faulty cord. not for the end result of what the parents should have been there to prevent.
Ms should be responsible for damages to the property, not the death of the child. Once the fire started damages were pretty much unstoppable.
saving the child, not so much so.
thats my view on it.
but MS isnt a big bad company because of it either, because they are not the only ones out there who do that sorta of thing.

I blame the fire being started on microsoft, and the babies death on the parents. They say the fire was started because the cable got to hot, right? Well if its getting hot im gonna assume that means it was on and being played. If i was a parent, and i was playing my xbox and saw my xbox catch on fire i'd think "Oh shit, the xbox is on fire. Hmm maybe the house will burn down, i better make sure MY BABY is okay." I just don't see how the xbox could have caught the house on fire and killed the baby before the parents realized. If they werent home, its there fault for leaving the baby un attended, if they were home its there fault for not saving the baby. The only POSSIBLE situation i could even think of that the parents wouldnt be at fault would be if they were asleep, the house caught on fire and engulfed/killed the baby before they woke up and or realized the fire was happening. Even then, im still guessing the xbox would have had to have been kept on for the fire to start which again, puts the blame on them.

The same can be said for you. An Xbox starts a fire, a baby is killed and you're so quick to blame the Xbox and dismiss that it was the cause of negligent and neglectful parents?

Hey all this talk about save the baby. How about... A fire breaks out from a wire connected to an Xbox... Put the fire out? Stop all the negative things that could happen from any other decision made? Like Raider said in a short version "Wtf the xbox is on fire.. Do something" Attempt to put it out, gather children and pets. Get the fuck out the house if its uncontrolable. I would be so upset if i read further into this and find somewhere the parents left the child alone in the house in the first place. Man... I understand some people would get upset with this with the child lost. Its a terrible thing. But these parents really need to think over what just happened to them.

Without further info there's no way to know how responsible the parents are if all. For all you know it was at 3 A.M. and they were downloading something from Xbox so left it on at night, the fire alarm went off and the baby was already dead.

I don't agree with the idea of a culture that likes to pass the blame for personal problems onto corporations, but this isn't Mcdonalds getting sued for making people fat, this is gaming machine getting on fire and burning an infant to death.

I'll just mention this, being unable to walk around and getting burned to death is probably a fairly unpleasant way to die.
