I cant disclose the location of the robbery because of legal action we are taking.

My brother works for a restaurant and while he was closing out getting ready to go home. Two Masked African Americans came through the back door with a Shot gun and hand gun. My brother was in the wrong place at the wrong time.

He was attacked in the back of his head with the back of the gun and Shot at.
He is still in the Hospital with a Stage 3 concussion and a 4 inch gash on the back of his head. There was a pool of blood as big as 3 feet when the paramedics got there.

He has 15 staples in his head right now and is very shook up.

My biggest gripe is 50 checking cashing stores, wallmart, 2 gas stations and a Boston market were robbed by the same 2 people.

My brother is also taking legal action against the company that he works at.

Honestly your brother will probably lose the suit against the restaurant. He doesn't have a case against them. I mean I guess they can be held responsible for his medical bills because this happened, but I don't see fault of the restaurant because 2 assholes decided to heist the place and attack your brother.

Drop the case against the restaurant it would be wasted time unless they don't want to pay for his medical bills because it happened on his property.

The manager left the Back door opened, which let the robbers in. He was also hurt on there property and they dont want to pay his medical bills.

Also he has a lawyer and even the lawyer told him he will win,

If it was a work releated incident he would win, but i can't imagine the case being won against the resturant. The back door being left open isn't the sole fault of the resturant owner, and that will only have an affect on the insurence for the resturant in getting the stolen money back, which they won't because of neglience.

All the best though. Good luck with the cases. I hope everything ends up okay and a full recovery.

Yes but the restaurant will say that he should have checked the back door to be locked. I still don't think your brother has a strong case. Yes it did happen on their property you're right so they may make a settlement of their insurance will cover so much of his bills. That isn't a win as the goal was to get the restaurant to pay for it all of it.

You have a case, but it's not 100% win if they offer a settlement make sure they're paying for a majority of his insurance.

I'm sorry this happend to you, its shity. It sounds like he's stable, which is the good thing. Go ahead with the lawsuit. The most important thing is to take down the scum that did this to insure that it doesn't happen to anyone eles.

A similar thing happend with my cousin last April. He was stabed in the neck and killed, but the fucker who did it wasn't his first victim. I wish there was just a more simple way in life to prevent these situations.

Crazier cases have been won. Referring to the case against the restaurant.

I'm sorry this kind of thing happened to your family, don't be discouraged by this event.

Hope they find the bastards. Terribly sorry about your brother.

I'm sorry about what happened to your brother, but I'm going to be honest here. Suing the restaurant is a very bad idea. He might win the CASE, but he's going to lose down the line. First of all he can kiss that job goodbye. That might be fine, but you have to look at the broader spec of things. Assuming you live in a smaller city (maybe you don't, I don't know), word of the incident will spread around. It's going to be really hard to find another good job as "the guy who sued his restaurant because they were robbed".

What he/you SHOULD be doing is looking over the worker's comp policy for the restaurant. Find out what kind of coverage his company gives its employees for various instances, find out if this applies and for how much, and then talk to his manager about it and go higher than the manager if need be. If the company has a clear cut worker's comp policy and doesn't honor it, THEN you could sue for worker's comp fraud, which will look a lot better than just suing the restaurant outright. Before doing anything of that nature, be sure to go as far up the restaurant hierarchy as you can armed with knowledge and information about what they are supposed to be doing for the situation, don't just sue blindly and without talking to the right people first.

If Workman's Comp. -have- to cover him to the extent he wishes, they would because they know how expensive court can be. If human error was a viable grounds to sue, we'd all be fucked. Think logically. "The Hole" is a very, very unhappy place to be, trust me, especially when you put yourself there.

It's up to you and your family, but don't let the thought of an 'easy to win' lawsuit screw things up in the long run.

I'm sorry about your brother, truly sucks when things like this happen to your family. But I'll be honest, I have to agree with Rappa. Even if you do win, he will most likely be fired, as has already been stated. I also have to agree that you lack a real case against the restaurant.

While yes, the manager did leave the back door unlocked, that's not actually something you can sue the restaurant over. Sure, it would prevent the restaurant to get money back from what was stolen, due to the manager being sloppy and leaving the door unlocked. Similar to how your insurance won't be valid on your car, if your car gets stolen because you leave the car unlocked with the car keys in the glove box. However, the robbery itself wasn't actually the store's fault. So yes, I'd have to agree with what's been said earlier. It would be a much better route to look over the company's policy to see if your brother should get any benefits he's not getting. They're also not allowed to fire him over that. But yes, that, too, would most likely get your brother on a bad foot with the company itself, so he would most likely want to quit after it anyway. But at least he wouldn't have the same kind of reputation.

Although its true, weirder cases have been won...
Robber Versus Old Woman, round 1. Robber sues old woman due to robber hurting himself on the knives left on the table, while breaking and entering. Case won.

/sigh. Perhaps we should sue all those rabbits racing down the street in North Carolina. Would be a good way to make some extra cash. Why rabbits have pockets with cash in them, I do not know.
