Well if you look at it from a stand point, he couldn't actually kill that Santa.
From the angle of the gun you can see it's not actually facing his head, but a way and in front. If the gun was to go off it would probably graze his hat.
Another factor involved is that's a big motherfucking santa. Judging from the drop shadow these two figures are on the same plain. So Nyz is a dwarf compared to the gorilla size santa sitting before him.
