Right above the Agree/Decline buttons:

If this software is licensed by or for any unit or agency of the United States Government, then this software will be classified as "commercial computer software," as that term is defined in the applicable provisions of the Federal Acquisition Regulations and supplements (the "FAR"), including the Department of Defense ("DoD") FAR Supplement (the "DFARS"). This software was developed exclusively at private expense, and no part of this software was first produced in the performance of a United States Government contract. If this software is supplied for use by the DoD, this software is delivered subject to the terms of this Agreement and either (i) in accordance with DFARS 227.7202-1(a) and 227.7202-3(a), or (ii) with restricted rights in accordance with DFARS 252.227-7013(c), as applicable. I can`t figure out why SE might find it necessary to say that.

Isn't it obvious?

The Army is looking for ways to defend the country against the Shadow Lord and the Kindred.

duhh, the al qaeda could use FFXI to learn how to fight the americans by using Besieged. Im sure our army wont know wtf to do when a giant fucking robot troll comes after them, with a swarm of al qaeda behind it.

BEE'S!

/dumbfounded.

Aside from it possibly being some kind of licence CYA paragraph that is quite literally mind boggling.

Like wtf is the DoD or american government going to do with FFXI or POL?

Furthermore wtf is SE putting in their packets/software than would require this type of stipulation?

Crazy japanesees <.<

maybe it keeps em from giving up the source code should a government employee purchase the game.

Isn't it obvious? The Government came up to SE asking if they could place recruiters in big cities like Jeuno, but were turned down because it's a multinational game.

Lawyers tend to copy other lawyers, especially when there is case law backing up a particular provision in a contract or licenses. Government clauses such as these are not uncommon in many EULA. You will very often see them in software where the company who wrote the EULA is doing both private and government work. (i.e. Microsoft, SUN, etc). Company B comes along as goes hey that is a really nice EULA and copies it making as few changes as possible, so that any case law already backing up the provision will remain intact.

I'd guess that the US Government retains the rights to software developed under US Government Contracts.
