I was a big fan of GNR but ever since Slash's departure, it just wasn't the same. Axl is pretty much a has-been now and yet he cant seem to get over himself, at least in my opinion. What yall think?

Can't believe how insane he is, he's suing not because they used his likeness, but because they used someone else's likeness who happened to be in the band before. Yeah it's Slash, but still, he has no legal right to Slash's image.

The first paragraph makes it sound pretty clear cut to me. They were allowed to use the song on the condition of there being no Velvet Revolver music in the game. Then there was Velvet Revolver music in the game. Is it petty and utterly deplorable that this is triggering a lawsuit? Yes. Does Axl have a case if that agreement was laid out in the contractual write-up? Yes.
