Long story short, this woman was fined $9250 for each of the 24 songs she shared on Kazaa, ammounting to $222,000. She was the first person in the US to actually be convicted of file sharing in a jury trial... But on the bright side, "According to the Chicago Tribune, Thomas shared files by such artists as AFI, Aerosmith, Green Day, Journey, and Guns n' Roses. Thankfully, now these struggling entertainers will be able to feed their families."

This makes me fucking sick...

How? She was stupid enough to take it to court instead of settle, and it's pretty fucking easy to prove.
Got what she deserved.

She fucked up, I have no sympathy.

She knew what she was doing was illegal, how could you not? She got caught and lost.

I think she got what she deserves, but I somehow wonder if an Association of recording industries is not illegal somehow. To me it sounds like insider trading practically. If they can privy each other to each's intentions, thats not healthy for the market and the government doesn't like that...

Just pay the entertainers you enjoy from the get go?

I'm not sure why its a sad day. Someone got busted for doing something illegal >_>

File sharing is the gil buying of the real world. If they wanted to really really crackdown on it, some people very close to you would get fined a shit ton of money. You probably wouldn't be saying, "Hahaha, you deserved it!" if it was your brother that got fined $220k.

With the amount of shit I download 220k is a bargain <_<

If I could buy the music/movies/episodes I want, I wouldn't download them. Till Then, I'm a criminal.

Don't do something illegal if you aren't willing to deal with the consequences. If you speed, do so knowing you can and will at some point in time get a traffic ticket. If it isn't worth the fine to get somewhere faster, don't speed. Same thing with downloads online. At some point in time when you break the law, you'll get caught. If you can't man up to it, don't do it. Pretty basic stuff.

Aye, but is the law legitimate or necessary? It's the same style of argument as legalization of pot.

Dumb people need to learn how to bittorrent or get a fucking Music blog. Dumb bitch got what was comin.

Thomas' case is particularly interesting, as she was convicted of having copyrighted material in her Kazaa shared folder, but not necessarily sharing them herself. The Times reports, "Earlier, the judge in the case, Michael J. Davis of Federal District Court, ruled that for jurors to find her liable, the record labels did not have to prove that songs on Ms. Thomas's computer had actually been transmitted to others online. Rather, the act of making them available could be viewed as infringement."

I find this paragraph disturbing. So you don't have to share stuff, simply have Kazaa installed now with music files in the share folder makes you guilty.

I'm not defending the lady but...........

Say you have Itunes, and you have network sharing enabled? Now you could be sued like here? Or say you mistakenly leave your C drive open on a network? What then? You don't have to share the files, if they can be simply accessed your guilty?

bleh.

That I find complete BS to be honest. If they didnt have to prove she was actually hosting and letting others download the songs just the fact she had songs on her computer then what in the fuck was wrong with jury. Im pretty sure almost every single person with a computer and copyed songs onto their computer from a legit and shop-bought cd, which say you were doing because you wanted to create another copy for your own personal use.

Dont know if its different here to over there but im pretty sure over here its - "Once you have bought and possesion of an item (Ie a CD) is legally transferred over to you, your entitled to make one copy of it for personal use."

I had no idea anyone still used Kazaa...
They might as well have fined her eighty hojillion dollars, she's probably never going to be able to pay...
It seems like I overuse ellipses...

Thread: when you're accused for things like this, don't be a total dolt and deny/take it to court
