this should be under the general topic, but eventually, this will end up here anyhow.

i have a child and am divorced. i understand child support and the reasoning behind it. problem i have with it is, its out to get people if you voluntarily decide not to pay or involuntarily decide not to pay.

for those that dont know how child support works, ill give some background.

child support is automatically deducted from pay from the non custodial guardian and is sent to the state where the state then sends it to the custodial guardian.

now, if you dont pay for whatever reason, what happens is a set of different steps.

first they will take your drivers license
next, they will take your bank acct and garnish wages
next, they hold a court hearing to find out why you havent paid
if there is a legit reason why you havent paid such as unable to get a job for whatever reason, they have the ability to set u up in a job program to help you find one that suits you. they also have an ability to put you in jail if the courts find you in contempt. IE: you have the ability to pay, but you dont.

now, they cant sentance you immediately to jail unless the court hearing is by a judge. they are typically overseen by someone else other than a judge.

heres why my beef comes in with this setup they have. they are logical reasons to get what they need from the non payer, however, it can be debated if they are good reasons.

now, these are going to be depend on what the persons situation is....so be mindful of that. i will give both sides

if they take your DL, you cant drive legally. which is a small roadblock in getting to work. or using a vehicle to find a job if thats what the case is. for some people, they may live in the sticks(boondocks) and without a vehicle, will make it very hard to get to or to get employment.

garnishing wages/taking bank accts. ... i have no real issue with this. this is a way for the state to ensure they get the money IF the person actually has the money but they decide they dont want to pay.

court hearing/jail...this is the one i have an issue with. if you had no job and very little jobs to choose from, (and by this time in the process, you dont have a dl to get to a job) you have a good chance of getting screwed over no matter what the courts decision is. if they decide to put you in a probation period to help you get a job to pay support, you have no way to get to interviews, to the probation meeting, etc.
now, if they toss you in jail, you arent gonna be able to pay your support after that either. so, whats the point? "you arent paying, so were gonna toss you in jail so you still wont be able to pay"

well, the courts will say that while in jail, you will work off the money you owe from the state. another problem is, if the process of paying is from the payer, to the state, to the caretaker. no one is still getting paid. basically, you are not generating revenue for the state, instead the state pays out of their pocket and essentially loses money by paying the caretaker what you owed.

discuss.!!!

Isn't there a case about a guy who was told by his GF that she couldn't have babies and she ended up getting pregnant, so now he's refusing to pay child support? I saw it on CNN in the clinic, but I was all drugged up so I couldn't tell what the honky's were arguing about.

The state has always been irrational in this. Personally I think its pretty self defeating for the state to do anything to someone incapable of paying their child support. Lets say dad, in this case, is not seperated from mom, and dad looses his job. The family would have to make due without. However, once they aren't married its a different story, now dad OWES mom. For some reason its ok for dad to be out of work and everyone suffer so long as they aren't divorced. Once mom gets fed up with dad not having a job and kicks his ass to the curb, dad suddenly has emotional trauma and no money. To top things off, half his shit was taken when he left. Shouldn't Mom take the half of everything she kept and use it towards their kid? There has to be a reason she gets to keep the stuff, and the "I'm accustomed to it" bullshit doesn't count.

Dad's used to getting sex from Mom. When they break up he doesn't get court mandated sex because he's accustomed to it. But mom gets half his stuff and can collect both alamoney and child support. Now if dad wasn't paying 2 bills each month, and seeing over half his paycheck dissapear because of it each month, I'm sure those child support payments wouldn't be too big of a deal to cope with. In most cases I believe child support is a % and not a set amount, because the government realized the the kid was only ever gonna get a % of the income and not a set amount under normal circumstances.

In nearly all divorce and child support cases dad gets screwed hard. Sure we get to pee standing up, but at what cost?

Well, can survive withotu DL
can keep money in cash instead of bank.
Can make money in.... not legal ways.

So taking freedom away is best way to make people pay child saport.

actually, i forgot to add that. child support, the way its "computed" is bullshit.
lets say if your out of work, you would think that if you have a legit reason to why you cant pay, you could have it deferred till you can pay....wrong. your still required to pay.
now, you would think that they would do a percentage and add up your own cost of living and take whats left. wrong. lets say you have a min wage job, they base the amount you pay off of the amount you make. lets say your paycheck a month equals 1k. lets also say, for shits and giggles, that your child support is 1k a month. guess what, they dont care if you dont have a place to live, the state gets their 1k and the payer gets screwed because they cant pay for a place to live, eat, etc

you can drive, however, caught 2x doing that, you go to jail.
you can keep money in cash, but how would you cash a check.the only way is through a check cashing place, but you pay out the ass for it.
you can make unlegal money, but you can go to jail for it as well

oops,
you can survive without a DL, and take the bus, cab, etc. but if your looking for a job, you cant afford to pay for those. there is always walking, but unless you live in a city, walking to a job or job interview is harsh

If a male can earn enough to support not only himself but 2 others, a female can do the same and shouldn't need the male's income. Of course I think they loose all of it if they get remarried. Of course, this is why mommy just has a live in boyfriend till kid turns 18.

well, you have to think of it like this. you helped create a child, you can help support it. thats fine and dandy. i understand it totally, but the state really isnt looking after the welfare of everyone. they wont care if someone is homeless, hungry, etc...just as long as they get their money, thats all that matters

Well if both parents get a decent deal with visiting right, I agree to paying a good chunk. If I had really strict visitation rights and got jerked around, I would not be so generous. I think the greatest concern every dad feels when they pay child support is mom spending all the money on herself and not actually using your money to support the child.

well, the good thing is that its based off of pay. but, if your in between jobs, then you tend to start being on the short end.
but, thats not a big deal. the part that really gets me is how they determine how much you pay. in florida, to live in a small apt and to survive, it costs about 800 bucks(includes water, elect). thats without cost off food or mode of travel. if they base the amt you pay off of min wage, your looking at about 1500 bucks a month. so, subtract 800 from that and you get about 700 left. from that 700, take about 200-300 for food for a month. so, you got about 500 left. now, lets say you have a vehicle payment averaging 300. that leaves you with 200 bucks. now, for min wage, you pay 256 bucks a month. your short 50 bucks.
most of these numbers are on the low end. so, you could end up being shorted even more. something wont get paid. but i guarantee the state is one of those that will get paid

also, forgot to mention, you HAVE to provide medical insurance for the child as well.

"You want child support? Get it out ya ass, bitch!"
-Ice Cube-

doh, forgot to add car insurance...
but if you change personal vehicle to cab, your going to pay about 7 bucks for about 5 miles. average jobs can range in distance but are usually 10 miles or more. so, thats about 15 bucks one way and that is 30 bucks a day. basic math tells us that is around 720 a month. (i think thats right)

This is the sorriest post I've ever seen.

If there wasn't the possibility of going to jail, noone would give there ex-wife money.

Do you have a problem supporting your child? Do you not care if your child has food/clothes/shelter? Why don't you want your child to have medical insurance?

If you aren't fully prepared to support your child till age 18, you never should have been fucking in the first place. Next time, tell her to get an abortion.

I just don't like the things I hear about where the mother never works since the marriage started, they get divorced and she never gets a job and just lives off alamony and off of her kid's child support.

The woman is almost always going to get custody. The guy may be perfectly able to support the kids if they are living with him, but now the state's making him support himself, a seperate residence for his ex-wife and kids and god knows how much money she's hording by the state taking more from him than the kid's need. Especially since it's based on his wages not her cost of living.

there are those that will and wont want to support a child. i, myself support my child. however, the world isnt perfect. people can lose their jobs and be down and out.
if your implying that i dont pay, your wrong. i do pay. however, if you look at it, if you go to jail, you still dont pay. so whats the point. and the medical insurance, i just threw that in there as another cost by the noncustodial parent that they have to undertake. with min wage jobs, and there are many parents that have min wage jobs, they will dig themselves into a hole because they cant support themselves plus the cost of the support.

also trippy, i put this up here as a debate, not a flame. so dont try to flame me. debates typically end up here, thats why its on this board. i bring up this debate because i got into a discussion about it a few weeks ago while i was on vacation

i hear people at work cryin that they need to pay child support all the time. i just laff and say to bad be a man and pay your dues. you helped bring the child into the world now help support it. any man who wont pay child support for his own child is a deadbeat piece of shit, and should be thrown in jail till they buck up.

i agree, people should take care of their responsibility. but SOME of the methods that the state uses could be revised a little
