child support

Or in many cases if a woman writes your name on the birth cerificate you can and will likely be held responsible. There's an article somewhere about a man that was forced to pay child support to a woman whom he had never met, much less slept with.

I believe it. In that case, it wouldn't be too hard to undo. The problem arises when the man foolishly believes the child is his, and acts as the father for many years. When he finally discovers he isn't the father, the doctrine of parentage by estoppel applies. Meaning that if too much time has passed with the man acting as the child's father, that it would be too harmful to the child to let the man off the hook, even if he can prove he is not the biological father.

Sorry to post again, but I can't edit my old ones

What Pierce didn’t realize, and what nearly 10 million American men have discovered to their chagrin since the welfare reform legislation of 1996, is that when the government accuses you of fathering a child, no matter how flimsy the evidence, you are one month away from having your life wrecked. Federal law gives a man just 30 days to file a written challenge; if he doesn’t, he is presumed guilty. And once that steamroller of justice starts rolling, dozens of statutory lubricants help make it extremely difficult, and prohibitively expensive, to stop -- even, in most cases, if there’s conclusive DNA proof that the man is not the child’s father.

i should have this moved to reality sinks in so we can edit

That's a little exaggerated, there is alot that can be done to stop it. But it's still scary for the man wrongfully accused.

Yeah, like hire an expensive lawyer and hope he's good enough. Noone reimburses your time or legal fees in this situation. Also what of the Child Support you've been forced to pay in the mean time. What about having your license pulled in the mean time?

So, how many ppl who are posting about this have practical experience? Either as a lawyer or someone who pays/receives (of should pay/receive) child support?

<-- Lawyer. I see men get shafted every day.

Men shafted every day. Gimme a break Resipsa. Also, are you actually a practicing attorney? Furthermore a practicing attorney in Family Law? Because I truly beg to differ about who is actually getting shafted thru the majority of divorces.

in reference to the OP, I'm right now the child involved in the Child Support case in my family. The man is not always the one paying the Child Support. My mother pays it, as I am living with my father(yes, I know you prolly didn't mean everything like that). I'd like to add to this, the state is a shitload less strict when it comes to the mother paying support. I know this because my mother is roughly $700 behind on her support, and refuses to pay it. No matter how much my father complains to the services, they do shit. I know she's behind because in Pennsylvania you can check-up on it when you complain. My mother has gotten NO punishment whatsoever. I mean absolutely nothing. She didn't lose DL, she didn't get put in court, she didn't get any money taken away, yet she's had a job the entire time. Because of that, I'm inclined to think the woman is not punished nearly as strict as the man. I'm not sure if something of the like was posted before, but just wanted to get that out there, cause it's gotten VERY annoying to hear about.

Since y'all want to make some bogus statements, I figured I'd give you some more reading for your pleasure.

http://en.wikipedia.org/wiki/Child_support

I especially would like you to read about this part:

Here is an excert to part of it. Mind you, this is the state of Illinois, but I'm sure it can apply to all states ...

"Dead-beat" parents

Main article: Deadbeat dad Non-custodial parents who avoid their child support obligations are often termed dead-beat parents. The typical non-custodial parent is the father, thus the common reference to "deadbeat dads". This prejudicial characterization of parents ignores the fact that many non-custodial parents are simply unable to pay at the rates they have been assessed. The US Department of Health and Human Services estimates that 68% of child support cases had arrears owed in 2003 (a figure up from 53% in 1999). Many of these arrearage cases are due to administrative practices such as imputing income to parents where it does not exist and issuing default orders of support. Some non-custodial parents claim their payments are too high. According to one study 38% of Illinois non-custodial parents not paying child-support said they lacked the money to pay. Twenty-three percent used non-payment to protest a lack of visitation rights. Fourteen percent complained of no accountability over the spending of their child support money, while 13% said they didn't want their child(ren) and 12% denied parentage. Additionally, some non-custodial parents who have been subject to acrimonious divorces often see these payments as unfair and excessive. Some custodial parents who have been victimized in abusive relationships view the avoidance of child support payments as another means of their spouses perpetuating the abuse.

I'm on my second marriage Master. I was married to Heather's father for 10 years and with him for 12. I've had 1 child. I've been with Steve for 16 years in May of this year and married for 12. Any other stupid questions?

By the way, I showed him some of the stuff that was written in this thread. He himself helped raise Heather since she was 6, this does NOT include supporting her financially, but he was there for her as a father figure. He has no children of his own.

He is absolutely abhorred by some of the comments in this thread. He lived it with me, and has seen what has happened with others in our rl. He is also very much for these new laws

No offense Kat, but if majority of the caretakers were the fathers, Deadbeat Mom would be the more used term. You forget that majority of the children are being taken by the mother. If it were the otherway around, I'm sure you wouldn't be playing this tune.

If it were the other way around, I personally would do anything and everything in my power to make sure my child was provided for. Just as I did because I had custody of my child. Again, a mother in most cases, not all I grant you, is that their child comes first. I believe the majority of mothers on this board feel the same way.

Bottom line, most men don't WANT custody of their children. When the marriage ends, they want their freedom and they don't want the responsibility of taking care of a child full time. Don't even try to bullshit me otherwise.

You are neither the only woman in the world, and the fathers that don't want to have anything to do with thier children aren't the only men in the world. You cannot compare your situation to another ones and cry out that it's even, or you had it harder, because you don't know thier story.

Are you saying your brother doesn't want to have anything to do with his children? Are you saying MO is the same way? Personal Experience is just that. Personal. You can't push it on other people and call it the norm.

And again, look at the statistics.
