Fffffuuucccccc****** Mmmmmeeeee BANNED -.-

I've had people call GMs etc. on me before but never gone to jail for using third party software. Last time I went to jail for harassing Pyoih, I asked GMs what would happen on next offense and they said I'd be banned. That's why you haven't seen any RMT harassment threads lately by me. :P Possibility Firestreak but doubtful.

They still rely on people reporting eachother, then examining the logs of your characters movement to determine whether you were cheating (and thus whether you're in line for a nice, swift, banning.)
I dont get it. Where in the logs does it show your movement?

And I'm with the others... punk chicks are hot. Well, some of em. Like those 2½ on your desktop.

And prostitutes don't sell sex, they sell the time and effort to coerce them into sleeping with you. As far as a legal issue, it's along the same lines as selling Chukie Cheese tokens. It may be against some minor law, but the US or Japan won't set up some elaborate sting operation to bring some Chinese company to justice over it.
they cant that be called entrapment

Entrapment just means the evidence gathered won't hold up in court, it doesn't mean they can't put the company out of business. Say we have special forces that use illegal means to confiscate half a ton of smack from drug smugglers, is a judge going to say "You went about that through illegal means, give the dealers their smack back."?

Copyright laws protect the software and the service that runs with the software. The virtual items within are not mentioned under any copyright law if you look and read them-- US, Europe, and even China. With no clear ownership of virtual items in an MMORPG, it is therefore assumed we, as players, have the right to ownership to those virtually created items.

This applies to botters and cheaters in this game. The ones who make the program for a bot that allow cheaters do what they want in this game are making programs that make no modification to the original code. The original software code is the ownership of Square Enix. But, since FFXI is not an open source software and there are no modifications to the original code itself by these bot programs, websites like www.ffxiapp.com continue to operate-- at the detriment of other players.

With all this, that means one thing: SquareEnix has no legal right or any possible way to take legal action against RMT players and programmers of and players using bot programs.
flee hacking motify the code there for can be banned, bots on the other hand can not be.. yet. Though it still seem that there are those rmt that do use mrArgus, yet still after 4 cut selections still play the game like are friends in castle oztroja. My guess SE dont want a court battle so they go after the people that wont fight back in this case GP.

If nothing else, maybe this teaches another "Well I only fleetool to get from point A to point B, it's harmless" player to stop using hacks and saves their account from the next wave.

I admire your honesty, but not enough to feel bad for you.

That sums up my feelings as well.

Good luck though.

if lets say member from SE bought gil then they banned the person who sent the gil that be entrapment. Plus like said above copy right dont tranfer over to virtual item. Till law is clerfied they not doing anything illigal.

Did they ever give you a 72hr suspension, before hand?

If not, that's pretty nuts if they can just skim through records to find that out.
Not everyone as lucky as some ppl hehehe

You're calling it entrapment like they're going to be taking these people to court over this, or that people would sue SE for banning them for selling gil. They could just ban the account of everyone who's character starts with the letter E and wouldn't have to answer to anybody about it; it's their game, they can do what they want with it. They might not be able to shut down the company but the method you said would be very effective in weeding out the gil sellers.

I highly doubt that. Claiming is sometimes just the luck of the draw. Don't be so bitter. You remind me of the kids from Quake3: ZomgZorZ everyonez is teh h4ckZ!!!11

And to Meeze its possible to flail when you DON'T have claim to Fafnir. Ssssssssome people DO forget blockaid, lol. Go BRD, Cure someone, Go around to the back, start spamming on Mazurka

Hey, I play still play Quake 3 religiously and most people aren't like that.

It's legal to say a copyrighted term without the owner's permission if that term isn't used to make a profit.

For example, if an RMT site said they were selling SE authorized gil or said they were the developers/publishers of FFXI, they would be in breach.

If they just say they are selling something that goes with it, they are not in breach of copyright laws.

Just like if you buy a 3rd party controller or video cable that isn't officially licensed by Sony for a PS2. The controller manufacturer can still say it's for Playstation 2, but they can't say it's made by the same company that makes the PS2 or say that it's an officially licensed product. Just look at all the 3rd party Ipod cases out there that aren't officially licensed by Apple.

What RMT are doing is contradicting the end user license agreement, which is really a grey area in courts. Some EULA are deemed overly obsessive while others can be held up using a precident. So even if SE tried suing gil farmers, RMT sites, and gil buyers, the chances are it would be thrown out in court because gil sites say they are selling the service of farming the money for the game and not for the actual gil itself. SE would have to specifically state selling the service of gil farming is against it's EULA for it to even stand a chance.

Snap. So really, to stop RMT... they'd have to build a time machine, go back to before the game hit shelves, and change their EULA?

I think they can just change the EULA, I believe they've already done it once before during one of the updates.

And what are gil sellers doing? Advertising "gil,"(wether gil directly, or the copout "we're selling the time it takes to farm gil!") to make profit. Regardless of how they go about saying it, it includes "Gil," "Final Fantasy," and a credit card number for them to use to fill thier pockets.

Would you not then be legally required to remove and re-install the game under the new terms? Or just agree with the amended terms?

The way they do it with WoW, is you have to accept the current ToS every time you install a new patch.

See, now that is thinking. Too bad the game is for homos.
