Judge overturns Prop 8!

I'm glad to see Schwarzenegger call for the ruling to go into effect right away. It almost redeems him for using his veto to strike down the marriage equality bills the legislature handed him.

In his defense the bills he vetoed were all voted on by residence of California, he was just honoring the votes. He did the right thing here. Unless this is something other than the bills I read about him when this was all fresh over his head.

Again, while straight as an arrow and Republican as the day is long, I'm hoping this goes over well for the Gay community. Marriage should be about love, nothing more, nothing less.

Divorce is wrong, but you don't see the courts and religious nuts up in arms over that. Ironic I say.

Face the Nation: David Boies v. Tony Perkins.

Tony Perkins makes me want to gouge my eyes out - the man is disgusting. Scary thing is, he screens relatively meek and assertive on television, which makes me worried that some viewers may actually believe he has something legitimate to contribute to the dialogue. Everything he says is either conjecture or a straight up lie. I am still confused as to why the media even entertains these Family people or NOM. Can we get a fact-checker in real quick to expose all the bullshit? Can we get a reporter to investigate the donors which give money to NOM or FRC (legally they must surrender names attached to larger donations upon request, but they never do)? Better yet, can someone set the IRS on their arses already?

Ah, Tony Perkins. I can't wait for the eventual tearful revelation of rentboys and long-stroke massages.

It's funny, a lot of these haters turn out to be closet gays, WHY!?

Because this is their way of dealing with it. They feel that if they act against it that it will somehow redeem or fix them. It's like the kid who farts in a classroom asking who farted, diverting all the blame and scorn away from themselves. It's actually pretty sad.

Never thought of it that way, but it makes a hell of a lot of sense.

Heh. I usually like to think they believe sex isn't good unless it's really, really dirty and deviant, which to them means gay-gay-gay. I wish they'd leave the well-adjusted, openly gay folks alone and just hook up with a goat or something.

and here I was thinking it was because it was contagious and since they have to spend time around it to fight it, they end up catching it.

Gay = T-Virus? I knew it....

Looks like it's possible that an appeal may be thrown out unless the state steps in. Back to your corner, anti-gay crazies. Although I think it's unlikely this matter will settle completely without a visit to the Supreme Court.

The judge raised the possibility that the backers of Proposition 8 — the ban approved by the state’s voters in 2008 — may not have a legal right to appeal his decision, since state officials have declined to defend the ban and seem unlikely to pursue their own appeal. The judge declared: “If the state [officials] choose not to appeal, proponents may have difficulty demonstrating Article III standing” — that is, the legal right under the Constituton to be in court.
The judge said he had offered Proposition 8′s backers a chance to spell out a harm that they would directly suffer if their measure were struck down, and the only reply was that they were interested in defending the measure. They failed, he said, “to articulate even one specific harm they may suffer as a consequence” of an order barring enforcement of the marriage ban.

The judge relied quite heavily upon a 1997 decision by the Supreme Court — Arizonans for Official English v. Arizona. That decision involved a 1988 ballot initiative in Arizona, declaring that English was to be the state’s official language. In that decision (written for a a unanimous Court by Justice Ruth Bader Ginsburg), Judge Walker noted, the Justices expressed “grave doubts” whether those who propose a ballot measure have standing separate from state officials to defend the measure’s constitutionality. (NOTE: While the Court expressed those doubts, it ultimately did not resolve whether ballot measure proponents may appeal to defend a measure when the state does not; the case was dismissed as moot, leaving that issue and others unsettled.)

The judge summed up on this point: “As it appears at least doubtful that proponents will be able to proceed with their appeal without a state defendant, it remains unclear whether the courts of appeals will be able to reach the merits of proponents’ appeal. In light of those concerns, proponents may have little choice but to attempt to convince either the Governor or the Attorney General to file an appeal to ensure appellate jurisdiction.”

Read up on this on foxnews.com. Have to say the comments there are pretty scary as far as how brainwashed some of the people are.

But by far this made me laugh.

It does not matter really what you believe. I believe this country is headed toward Comunisiam.

That type makes me want to scream out COMMMMMMMMMMUNISIAM!

Deep down I'm glad Prop 8 won the majority vote, but only because of the comedy it has provided. I think this gem was on CNN:

Gay marriage should not be legal because two hairy men kissing is just gross and that is wrong.

Reading these comunisiamist quotes on different news sites has made for a great 2 weeks.

Both sides have stupid sheeples following them not just the right...

This.

Lack of rigorous examination of their own positions is endemic to both sides of the political spectrum. In fact, I'd argue that anyone who identifies themselves as simply as "Liberal" or "Conservative" probably hasn't ever really thought through the matter with any care, and is most likely simply adhering to a set of beliefs that they've inherited, rather than ones that they chose for themselves after a painstaking analysis of the options.

I identify myself as a liberal because I've thought the matter through. If nothing else, I've grown even more liberal over the years as my dim view of conservatism has been reinforced over and over and over again. That alternative holds little interest for me, which is fine because I believe the feeling is more than mutual.

Socially liberal, fiscally conservative - that's generally where I stand. I'm registered Republican at the moment, but only because I didn't understand politics when I was 18 and registering. I'll be going Libertarian most likely. On topic, though, I really hope this causes a cascade effect across the remaining states and the US can officially make gays equal like they did women and blacks. That way there, we can get on to abolishing capital punishment and tackling other issues where we also stand way behind the rest of the civilized world. On a lot of matters where it counts, the US isn't as civilized as I'd like. Europe has its problems to be sure, and Canada, but in general, they've mastered the art of human rights. I hope the US heads that way too.

You know your country is in bad shape politically when you have more faith in a group of video gamers talking politics on a forum than you do with the people actually in office...
