It is if you get 'em in the eyes.

My dad's Serbian buddy freaks me out sometimes.

In CA if you are beyond where you are supposed to pay, it is shoplifting. Friend of mine worked at Marshall's in SF, and if he was forced to stop people outside he probably wouldn't have stopped anyone, but since he was allowed to stop them at the top of the escalators which was still inside, he did pretty good.

That sucks a bit, I still don't get this fascination with carrying knives/guns around with you. It's starting to spread over here aswell now :(

It's the violent video games!

Yeah I can't afford a laywer. I've been thinking about just pleading guilty and getting it all over with, if I fight it it's gonna be long and drawn out and costly and I really doubt anyone's gonna believe me anyway.

And that's a good idea Wes, but the cops who arrested me were as white as I am.

H... don't you get free lawyers if you cant afford one in America?
Considering there is absolutely no proof you were stealing the crap I'd think this wuld be an open and shut case and the search would be considered illegal.

Yeah I'm sure we do, but that's alot of work to go through for such a small case, and I'm pretty lazy. That and I don't even know how to go about getting one.
And like I said, technically, under Colorado state law, it was stealing, I don't think I have much of a case.
Aweful lotta trouble I got in for a bad habit.

What the fuck happened to innocent till proven guilty? I see no atual proof you stole jack shit. It's not like they had shopping carts fo you to carry around all your crap in did they?

Wow, you are exactly the reason why cops can be corrupt, if people dont stand up for their rights then soon your country will be bending you over like slaves.

Whatever you do Ex, don't plead guilty. There is a good chance that the cops won't show for the trial and the case will be dismissed. I've had many friends get off that way.

You've convinced yourself that you have a bad habit?

Meeze mentions in CA their law. I can understand that, but in your case you went to look at something beyond the registers, on display, prior to checking out. Checking out was your intent the entire time correct?

Putting your hands in your pockets is not a bad habit. You should get a public defender if you cannot afford a private attorney. If you don't fight this, you really are lazy, will get what you have coming to you, and I won't feel the least bit bad for you that you will have a lasting mark from this.

Fight it, if indeed you have given us the whole truth and nothing but the truth. If you haven't, this kind of sounds like when a lot of people got banned from the game and said they never did anything. The a year later...."Well there was one time, but..."

You guys don't understand, in CO, what I did was breaking the law. The only way I can fight this is to fight the law itself.

Did you know that was the law before tonight? I mean specifically, did you know that if you walk past the registers with cheese in your pocket, you could expect to get arrested?

I don't think you knew that at all, or you wouldn't have done it.
If you did know, and did it anyway....whatever. Have fun in court, lol.

No of course I didn't know that, but I just looked it up: http://198.187.128.12/colorado/lpex...n-doc.htm&q=petty theft&x=Advanced&2.0#LPHit1
I'm fucked

wait wait wait....I just read that again

b) Knowingly uses, conceals, or abandons the thing of value in such manner as to deprive the other person permanently of its use or benefit; or

First off, it's a habit of mine, I do it subconsciously, not knowingly, And secondly, I didn't deprive Safeway of it's use or benefit, I didn't damage the cheese at all, they probably put it back on the shelf...of course the doughnuts were probably a little smushed, but I'm sure they coulda still been sellable .

(c) Uses, conceals, or abandons the thing of value intending that such use, concealment, or abandonment will deprive the other person permanently of its use and benefit; or

I never fuckin intended shit! You can never really prove what someone is intending to do, the biggest case for that would be if I walked out the door, which I didn't. I am so glad I looked this shit up for myself, I'm gonna fight this.

Please guys, any imput on this would be appreciated. Is what I'm seein here valid? Does this mean I can claim a wrongful search and get the possession of an illegal weapon charge dropped too?

EDIT#2: LOL! I just looked at the TV and Inu Yasha is on, some chick has a HUGE boomerange XD Can you say, 'excessive'?

Man....I am so happy right now, I'm literally jumpin up and down....I gave myself a headache, damnit >.>; Pot is good for headaches, too bad I gotta lay off the shit till this is all over, better safe than sorry. Srsly, I can't remember the last time I was this happy. Oh yeah, it was a few days ago when I put the Zelda:TP disc in. And a few weeks before that when the first episode of the new 24 season came on. But other than that, I can't remember the last time I was this happy.

You'd better be a dog catcher or affiliated with a bunch of animal rights gropus to convince anyone of this story.

I'd say you were stealing off top if I saw you concealing. Most people have a notion that putting items in your pocket = theft. I also walk around hands in pockets for the most part, but at a store I know what it looks like with product in my hands while doing so, so I refrain.

If you bothered to check the whole page, my stoner friend, you would have seen that a theft less than $100 is considered a Class 3 Misdemeanor. You'll just get fined for it.
