It's official, Xbox kills babies.

I'm not sure how long they're liable after a recall, but this death happened BEFORE the recall occured.

If the Xbox was used in some way highly irregularly to make it more prone to burn, then that's something altogether. But what condition could the Xbox realistically be in that would create a massive fire hazard? I find it hard to believe they drenched it in lighter fluid.

Legality wise, how long is Microsoft liable for these faulty power supplys? Surely they can't be responsible for them years after a public announcement and recall. They did everything they could without sending mails, E-Mails and telephone calls I figure (I saw it on the news). If they are liable this long after it all I'd be very shocked.

The fire happened in Dec. '04 and the recall happened in Feb '05, so even if the recall could absolve them of liability, it can't work ex post facto.

you think that's a rare case? lol.. I remember reading a statistic that 1,400 kids are killed in the same or similar ways a year.

I would really love to see the statistic that says 1.5k kids a year are killed via falling TVs.

Ah, I should have payed more attention to find out this is OLD information no longer of any relevance. So why the post... Sony got you down?

Firestreak is right about the legal system. Moves slower than a depressed snail going up a 80 degree angle.

Anyway, you're a parent, the child is 3 (that's what someone said) and there are electronics exposed. It's not hard to get a small movable fence to block off reach for the child. It's not hard to replace your fire alarms batteries.

For all we know the parents could have been involved with the fire starting and the baby wasn't planned to get killed. It could have been a plan to sue for property damage and make money off of Microsoft.

Or it could have been a complete accident. Although really, with a baby dead after the incident, you have to blame the parents for negligence too. The power cord/supply doesn't just randomly cause a fire. (while it's off I mean). Some people go as far to unplug shit they aren't using.

just for the record, I said 3 and that was in regards to the child getting crushed by the TV in my one post a bit back there. I think the child in this case was younger. So point still stands for you, I do believe.

It's got nothing to do with system wars really unless you think the odds of being burned to death by result of a game system is high enough to affect a buying decision. It's about a kid being burned to death and a corporation trying to fuck the family over.

Absolute bollocks, you'll find any piece of info you can find to put down anything to do with the 360. I think it's sickening you're using someone's loss just to try and get one up on the 360 fans. If you don't like the 360 or Microsoft just don't post in here.

Grow the fuck up, you pathetic, ball-less sack of shit.

We spend months arguing over the superiority of different color schemes, over different online services, over the position of the D pad and left analog stick and over which system's weaknesses are responsible for the GTA4 delay, and I talk about something that may actually be relevant to the real world and you act like it's a moral sin.

NO, it's got nothing to do with the fucking system war. Xbox is not losing any exclusives over this. It's not going to change your online service, or your system reliability, or your install base. It's merely something that happened that I'm discussing here. It's not far out of the area of, for example when I brought up Sony killing a goat in the God of War 2 celebration, though I'm sure all the Sony haters that were so disgusted have nothing to say over this.

What's really fucking sickening is that people like you take a dead baby and try and judge it in relevance of the console war. Oh fuck, it must be the parent's fault! It's just Firestreak hating on the Xbox again! No, god damnit, this is something that actually happened, something that actually matters and rather than think about it or ignore it you need to attack it like it's some console war bullshit. You want to take the perspective that I'm the disgusting one here, as you have people go on here talking about parents with kids burned to death by faulty electronics and kids crushed by TVs and the first thing that pops in their head is to talk about how they were negligent?

You think the parents would be offended that people are publicly discussing the fact their baby was killed and that legally Microsoft is bullying them? You think they don't want MS to get bad PR for this? Furthermore do you think I'm saying that Microsoft is evil therefore you're evil by being their customer? You think I saw this story, ran to the electronics store and bought an Apple? I'm posting this on a laptop with Windows XP on it. Does this have anything to do with the PC wars?

The problem is, theres stories every couple of days about people being hurt through malfunctioning equipment. It's just that you decided to post the one about something related to the Xbox.

So really, why did you post it if not for what Sharpe had said? Especially with the title you posted with.

XBOX KILLS BABIES is just blatant trolling. A better idea would've been to use "Family loses child in fire caused by an Xbox" or something along that line.

If there are people killed by consumer electronics all the time, why post about this? Because this is an X-box board, being the place to put it, and the legal response of MS is heartless, making it newsworthy.

Hands Fire the story of "The Boy Who Cried Wolf".

Even if you had a valid point here, no one cares. At all. You have virtually no credibility here, especially on the 360 boards.

Posting this kinda crap here is like reading the sports papers. "Steroid use taints Bonds' record". That article is clearly going to be biased.

And the fire apparently started on the wrong end of things. MS acknowledged the faulty cords could cause a fire on the console end of things. The fire, from what I've read, started from the wall socket side. Red flag #1

The family is suing 3 corporations. Wal-Mart, Microsoft, and a power supply manufacturer. MS and the PSU manufacturer are reasonable, but Wal-Mart is a bit of a stretch. Red flag #2

The family is suing 2 large corporations, and presumably a third. Yet they're only claiming $25,000 in damages. When it's been a baby that died. Probably the most sympathy generating living thing that could die in an accident. I mean, didn't the lady who spilled coffee on herself, or the guy who caught his junk in a toilet seat sue for more? Red flag #3

The reason they only claimed $25,000 was to keep the case out of federal court. Wal-Mart has cited the familiy's damages at $75,000. Which would take it to federal court. When the defendant of your lawsuit is a huge company, and says your damages are 300% of what you claimed, that generally spells bad things for you. Red flag #4

The lawsuit names an Xbox 360 as the culprit. Despite the fact that the console wasn't released until around 6 months after the fire. Red flag #5

And what's really sad about this whole affair, aside from the baby dying of course, is that you're using it to fuel your own anti-xbox agenda. You're not fooling anyone, and you're not being clever. "I know! Instead of saying what I'm really doing, I'll act like the exact opposite. That'll work for sure! Hyuk hyuk!" If you had said something like "These past however many years, I've trolled these boards, played devil's advocate, and been a general jackass for no reason, but seriously read and think about it", it might've carried a little weight. Saying it like you did, "You fucking fucker! How fucking dare you fucking suggest I would use this fucking tragedy for my own fucking alleged anti-xbox fucking agenda? You fucking sicken me. You fucking fucked-up fucker", is just as bad as coming out and saying it. Worse, actually. It's like hiding an elephant behind a blade of grass. You're insulting our intelligence.

Anyhoo, the lawsuit is full of holes, and won't hold up to scrutiny, but then again, that's most of what Fire posts anyway.

The "Boy Who Cried Wolf" is a story based upon the principle that someone who constantly lies won't be believed when it's important. You can say I have a disposition to dislike the Xbox 360 as a gaming console, it's however quite different to say I constantly spread actual lies. I complain about certain features of the 360, and we debate certain validity of different sources, but I don't lie to support my position, nor does anyone here say any actual lies to bash the PS3.

Even if you had a valid point here, no one cares. At all. You have virtually no credibility here, especially on the 360 boards.
Maybe you don't care? Seems to me like you have a problem listening to the opinion of someone who doesn't share your tastes. To each their own, just because someone's an Xbox fan doesn't mean I assume they are liars.

Reality is biased against Microsoft?

Where did you read this?

The family is suing 3 corporations. Wal-Mart, Microsoft, and a power supply manufacturer. MS and the PSU manufacturer are reasonable, but Wal-Mart is a bit of a stretch. Red flag #2

I assume it was their lawyer's decision. It was a bad one too, Walmart is highly litigious and never settles.

You'll need to cite this as well as explain how this throws any doubt on the case. The amount being sued for doesn't seem to have any bearing unless it's on the other side, and they're suing for far more than reasonable.

The lawsuit names an Xbox 360 as the culprit. Despite the fact that the console wasn't released until around 6 months after the fire. Red flag #5

It's a strange thing to be nit-picking. We all know the Xbox 360 wasn't responsible, including the family who owned the Xbox. It was obviously a mistake on the part of their lawyer naming the wrong system on their paperwork, does it really matter?

And what's really sad about this whole affair, aside from the baby dying of course, is that you're using it to fuel your own anti-xbox agenda.

What's sad is that in order to protect your own agenda you feel compelled to either defend Microsoft or draw the issue away from said baby.

You're not fooling anyone, and you're not being clever. "I know! Instead of saying what I'm really doing, I'll act like the exact opposite. That'll work for sure! Hyuk hyuk!" I don't pretend to be what I'm not. I never claimed to be impartial. I'm not going to lie and say that I'm being impartial now as you suggest I do. The fact that you're such a god damn pussy that you can't even express your own side without resorting to some crutch like claiming I'm here to "troll," or I'm some big bad internet villain is sickening.

I don't play devils advocate. I am simply not interested in presenting my beliefs if they are going to be in the majority. It's pointless and boring for example to discuss why I think marijuana should be legalized at a message board for pot smokers. My beliefs are my beliefs because it's how I feel, and no other reason. They don't change based on circumstance and I don't shy away when they're unpopular, even at the risk of being called a troll by some dumbass such as yourself.

Anyhoo, the lawsuit is full of holes, and won't hold up to scrutiny, but then again, that's most of what Fire posts anyway.

The only thing full of holes is your stupid ass argument. You must have felt pretty clever though when you typed it up, too bad your biggest mistake was clicking that submit button. Next time save us both the trouble and stick your foot up your own ass instead of making me do it.

We should stop MS and Sony!!! Look the PS3 kills too!!!!!

Look at what the PS3 caused here. No playstation no problem, also wal-mart is should be in trouble too how could they let this happen in their parking lot?

Obviously the parents have no reponsablity in this situation either. Sad that Playsation can cause 1 brother to kill another.

PS3 the cause of a small crime wave.

I just want to let people know the true danger of the PS3.

Nah I honestly have nothing against the PS3 Im not going to their board just to try and rip it down. If they enjoy and are happy with it who am I to tell them not to have it. You should buy the system you enjoy playing and having or both if you enjoy both. There is no need to go around swinging your e-peen trying to bash others decisions.

This one was by far my favorite:

"Police were called in to breakup an unruly crowd who’d gathered in front of a Fresno Best Buy prior to the PS3 launch. The near riot was reportedly set off by a middle aged man with a mohawk, identified only as Fat Jerry."
