That sucks a bit, I still don't get this fascination with carrying knives/guns around with you. It's starting to spread over here aswell now :(
I carry around a pocket knife because I actually use it. It's not something that could be used effectively as a weapon, but it's good for the small things that always seem to show up needing opened.

I got jumped once or twice during that blackout in NYC a few years back, so I just carry and otf with me from now on. Or I used to. Not really anything that big of a threat here in Vegas unless I go to the West Side.

This just goes to show, Never put doughnuts is your pockets. They make bags for them. If you ask me this is the most damaging information.

Yeah I'm sure we do, but that's alot of work to go through for such a small case, and I'm pretty lazy. That and I don't even know how to go about getting one.
And like I said, technically, under Colorado state law, it was stealing, I don't think I have much of a case.
Aweful lotta trouble I got in for a bad habit.
ur innocent until proven guilty get a public defender at least just go to the DA office or court house and get one

Did you know that was the law before tonight? I mean specifically, did you know that if you walk past the registers with cheese in your pocket, you could expect to get arrested?

I don't think you knew that at all, or you wouldn't have done it.
If you did know, and did it anyway....whatever. Have fun in court, lol.
Most courts run under a policy of "ignorance is no excuse." The law was public, and he could have checked it at any time, so just because he didn't look it up before hand isn't a defense in court. You can sometimes get away with that when the police stop/arrest you initially(I've done it for a traffic violation that I didn't know about) and they will sometimes let you off the hook if it wasn't a big deal in the first place; but almost never once it's actually gone to court.

I'd say you were stealing off top if I saw you concealing. Most people have a notion that putting items in your pocket = theft. I also walk around hands in pockets for the most part, but at a store I know what it looks like with product in my hands while doing so, so I refrain.
I agree with meeze, I too put my hands in my pockets a lot, but I don't do it when I was carrying something to buy in a store.

Also, you did knowingly conceal the item. You may not have thought about it, especially since it's a habit, but since you know about that habit, you knowingly did it. The intent will be more difficult for them to prove, but it will be for you as well. Yeah, your intentions might have been perfectly innocent, but your actions look guilty as hell; especially considering the law defines shoplifting as just concealing the items.

You can try fighting it down, it likely won't be just a "show up and win" kind of thing, but it's certainly possible. If you lose though, it's probably just a small fine, so it won't be a big deal.

I hope you've learned a lesson: use those homoerotic handbaskets they put at the entrance.

Please tell me you didn't put the doughnuts straight in your pocket without putting them in a bag first. And who the hell steals doughnuts and cheese anyways... are you starving or just a fatass?

Of course I put em in a bag first...like I want frosting in my pockets and on my hands, what kinda question is that?

The point is, I'm inoccent until proven guilty right? And they can't prove my intent. I'm gonna look in to getting a laywer today.

They can't always prove someone with XXX amount of drugs intends to sell them, but they don't seem to have a problem convicting people of that now do they?

You're going to have a harder time arguing that you never intended to shop lift than they will arguing that you were; mainly because you put the stuff in your pockets and were walking towards the exit. While your intentions might have been completely innocent(ie. not shop lifting, but just looking at stuff near the door), your actions looked guilty as hell and it'd be a difficult thing to win based on "but I was going to buy them, honest!" Most people just flat-out won't believe you.

Ah just fight it. Public defense lawyers come out of tax dollars, not your (direct) pocket. I think. What can it hurt?

I think having a discussion with a lawyer, and telling him/her your side of it will be the best way to get a professional opinion in regards to the great state of Colorado.

Perhaps it would be worth your while to again explain your "bad habit", the fact that you were looking at something beyond the registers (that the store placed beyond the registers), and had every intent to pay the nominal amount of money for some cheese and doughnuts when you were ready to leave the store.

Additionally, it would bolster your character traits of actually paying for things if you can prove you do regularly pay for things. i.e. your bills, on time....

If you say there was no intent to steal, you explain why you were beyond the registers, you show yourself to be one to handle yo bidness, I wouldn't guarantee that will allow you to walk, but it could work out to your benefit. A presentation of the facts from your side and relevant facts about your character would show that the store clearly overreacted over some cheese and doughnuts. Obviously they don't want to be ripped off for 5 dollars or 50 dollars, but it sounds like this could be cleared up with some explanation and presentation of your side, or at the very least, softened.

Or maybe rolling over and letting this shit fly is ok for you. Give it a shot. I wish you luck.

So you people tell me to fight it but don't think I'll win? >.>;
Fight it, but don't go in expecting that it's a sure thing that you will get off easily.

Safeway sucks balls, I worked there for a bit (in Canada)... If you think someone is stealing or intending to steal, you're supposed to speak to them, not like be all "HAY WHAT'S IN YER POCKETZZ?!" You're supposed to direct them to the cashier and give them the benefit of the doubt, assuming they were going to pay for it...

I'm not sure if one of the employees of Safeway stopped you, or some random cop wondering around in Safeway approached you. >.> So yeah... it's bullshit, you got unlucky with the visene and knife. :(
